Florida has filed a lawsuit against Discord, one of the world’s most popular online communication platforms, accusing the company of failing to adequately protect children from sexual predators and misleading parents about its safety measures.

Florida Attorney General James Uthmeier announced the lawsuit Thursday in Tampa, following a state investigation that began in March.

The complaint, filed in Florida’s 20th Judicial Circuit, alleges that adults were able to impersonate minors on Discord and establish contact with children without sufficient age-verification safeguards.

Eight Cases Cited in Lawsuit

According to the Attorney General’s Office, the lawsuit describes eight incidents involving the alleged sexual exploitation of minors through Discord between 2022 and 2026. Each case involved a Florida victim or perpetrator.

One example cited by state officials involves a 60-year-old man from St. Cloud who allegedly pretended to be a 14-year-old boy and communicated with nearly 300 minors.

State investigators also highlighted cases in which children were allegedly contacted through gaming platforms before conversations moved to Discord.

Florida argues that Discord’s existing safeguards have been inadequate to prevent dangerous adults from targeting young users.

Florida Seeks Major Financial Penalties

The lawsuit accuses Discord of violating Florida’s consumer protection laws and legislation intended to protect children online.

State officials are seeking court-ordered changes, including stronger age-verification systems and restrictions on collecting children’s personal information without parental consent.

The state is also requesting financial penalties that could include:

  • Up to $10,000 for each willful violation of Florida’s deceptive trade practices law.
  • Up to $50,000 for certain violations involving children’s online safety.
  • Up to $150,000 for violations where the company allegedly knew a user was under 18.

Attorney General Uthmeier has suggested that the potential penalties could total hundreds of millions of dollars, depending on the court’s findings.

Discord Responds to the Allegations

Discord disputes the state’s characterization of its safety practices.

In a statement reported by WCTV, a company spokesperson said the lawsuit does not accurately reflect the platform or its investments in protecting users.

Discord says it actively detects and removes child sexual abuse material and continues cooperating with law enforcement.

The company has also announced additional age-assurance measures and safety settings for teenagers.

Florida officials acknowledge those changes but argue that they do not adequately address the alleged failures identified during the investigation.

Growing Scrutiny of Social Media Platforms

The lawsuit is part of a broader effort by Florida officials to increase accountability among technology companies.

The state has previously pursued legal action involving other major platforms, including Roblox, Snapchat, Meta and TikTok.

Discord is also facing scrutiny and legal challenges in several other states over child safety concerns.

The Florida case now places renewed attention on a question facing the technology industry: Are online platforms doing enough to protect children from adults who misrepresent their identities?

The allegations against Discord have not been established in court, and the company has the opportunity to contest the lawsuit.
